The following warranty applies to TEMPUR-ProPerformance, TEMPUR-Classic Cotton, TEMPUR-Luxe Egyptian, TEMPUR-Breeze Sheets.
Tempur-Pedic North America, LLC warrants to the original purchaser or user that the accompanying product will be free from defects in materials and workmanship for a period of 1 year from the date of the original retail sales invoice. If during the warranty period, this product is found to be defective because of defects in materials or workmanship, it will be replaced without charge. Notice of a claim under this warranty must be given promptly in writing, in no case later than 45 days after the discovery of the defect. This warranty will become void if the product shows signs of careless handling or if the product is ripped or torn. In addition, this product must be cleaned in accordance with labeled product care and use instructions. Any implied warranties shall be limited to the duration of the 1-Year Limited Warranty. In no case will Tempur-Pedic® be liable for the incidental or consequential damages, whether such damages are claimed on account of the breach of warranty, breach of contract, negligence or strict/product liability, including without limitation, damage to property other than the product) or economic losses. Some states do not allow limitations on implied warranties or the exclusion or limitations of incidental or consequential damages, so the above limitation or exclusion may not apply to you. HomTex, Inc. (“HomTex”) warrants to the original purchaser or user that the accompanying product will be free from defects in materials and workmanship for a period of 1 year from the date of the original retail sales invoice. If during the warranty period, this product is found to be defective because of defects in materials or workmanship, it will be replaced without charge. Use of the product diminishes the loft of the filling material. Notice of a claim under this warranty must be given promptly in writing, in no case later than 45 days after the discovery of the defect. Defective products must be returned, along with the invoice, prepaid to HomTex at the address stated below. HomTex will prepay shipping charges for the replaced product. This warranty will become void if the product shows signs of careless handling or if the product is ripped or torn. In addition, this product must be cleaned in accordance with HomTex's care and use instructions. Any implied warranties shall be limited to the duration of the 1-Year Limited Warranty. In no case will HomTex be liable for the incidental or consequential damages, whether such damages are claimed on account of the breach of warranty, breach of contract, negligence or strict/product liability, including without limitation, damage to property other than the product) or economic losses. The following 1-Year Limited Warranty applies to the Primaloft Comforter and Down Comforter.
Downlite Pillows, Comforters, and Mattress Pads are warranted to be free from defects in materials or workmanship for a period of one year from the date of purchase by the original consumer. This limited warranty does not apply to damage or loss caused by accident, misuse, or failure to follow the use and care instructions. To qualify for this limited warranty, the item must be cleaned in conformance with the manufacturer’s instructions. Should the item have a defect covered by this warranty, simply return it to store of purchase along with a copy of the sales receipt or proof of purchase. The item will be replaced with an identical item or, if unavailable, with an item that is equivalent in design and quality.
The following Limited Warranty applies to TEMPUR-ProAir and TEMPUR-Rayon from Bamboo Sheets.
